This policy is separate and distinct from our general Privacy Policy and applies specifically to “consumer health data” as defined by laws including the Washington My Health My Data Act (MHMDA), Nevada SB370, and the Connecticut Data Privacy Act. It is provided by StudioV AI LLC d/b/a Luxtra.
What consumer health data we collect
Some Luxtra features may collect or generate information that could be considered consumer health data, including:
- Journal entries, goals, and life events you write, which may reveal mood or mental‑ or emotional‑health status;
- “Wellness”/mood and reflection features and any mood or emotional‑state tags;
- AI‑inferred characterizations about your emotional or psychological state derived from your messages, journals, or birth data;
- To the extent applicable, biometric‑adjacent data from palm/face/voice features (also covered in the Privacy Policy, Section 3).
We do not collect medical‑provider records, diagnoses, or precise health‑facility location.
Biometric (palm and face) features
When you use a palm‑reading or face‑reading feature, the photo you provide is sent to the AI provider solely to generate the reading you requested and is deleted immediately afterward. Any data derived from the photo is retained no longer than three (3) years. We never sell this biometric or biometric‑adjacent data, and we never use it to identify you. Our AI providers — Google (Gemini) and OpenAI, on their paid tiers — do not train their models on this data.
How we collect it
Directly from you (what you type, upload, or speak) and derived by our AI when generating readings or reflections.
Why we use it
Solely to provide the reflection/wellness/astrology features you request, to operate and secure the Service, and as you direct. We do not use consumer health data for advertising, and we do not sell it.
Consent
We collect, use, or share consumer health data only after you opt in:
- Collection/use: before you first use a mood/journal/“wellness” or AI‑reflection feature, we ask for your affirmative consent.
- Sharing: we obtain separate consent before sharing consumer health data with the AI/service providers above.
You may withdraw consent at any time in Settings → Privacy, or by emailing privacy@luxtra.app; withdrawal stops future processing.
Your rights
You may: confirm whether we process your consumer health data and access it; obtain a list of third parties we shared it with; delete it (including requesting deletion by our service providers); and withdraw consent. We will not discriminate against you for exercising these rights. Email privacy@luxtra.app; we respond within the time the law requires (generally within 30–45 days).
No geofencing
We do not use geofences around any health‑care facility or location to identify, track, or send notifications/ads to you based on your proximity to it.
No sale
We do not sell consumer health data. We will not do so without a valid, separate authorization that meets the requirements of applicable law.
Retention & security
We keep consumer health data only as long as needed for the purpose you requested or as required by law, then delete or de‑identify it. We protect it with the safeguards described in our Privacy Policy, Section 14.
